Acceptable Use Policy

This Acceptable Use Policy ("AUP") supplements the GamesTally Terms of Service. By using GamesTally, you agree to comply with this AUP. Violations may result in suspension or termination of your Account without notice and without refund.

1. Purpose

GamesTally is a live event scoring platform designed for legitimate corporate, educational, and community team-based scoring activities. This AUP describes uses that are not permitted on the platform, regardless of whether they are technically possible.

2. Prohibited Content

You may not use GamesTally to create, store, transmit, or display content that:

• Is unlawful, defamatory, harassing, threatening, abusive, hateful, discriminatory, or obscene
• Infringes any intellectual property right, including copyright, trademark, trade secret, or patent
• Violates the privacy, publicity, or other rights of any third party
• Promotes violence, terrorism, self-harm, or illegal activity
• Contains sexually explicit material, particularly any content involving minors
• Contains malicious code, viruses, malware, ransomware, or any code intended to disrupt, damage, or gain unauthorised access to systems
• Facilitates illegal gambling, betting, or wagering activities
• Is fraudulent, deceptive, or designed to deceive other users or third parties
• Impersonates any person or entity, including GamesTally staff

You are solely responsible for the team names, event names, custom scoring labels, and other content you submit to the platform.

3. Prohibited Activities

3.1 Misuse of the Platform

• Use GamesTally for any unlawful purpose
• Use GamesTally in any manner that could damage, disable, overburden, or impair the platform or interfere with any other party's use
• Bypass or attempt to bypass any usage limits, plan restrictions, or security measures
• Falsely claim eligibility for the Educator tier
• Create multiple Free tier accounts to circumvent paid plan limits

3.2 Technical Abuse

• Attempt to gain unauthorised access to any account, system, or data on the platform
• Probe, scan, or test the vulnerability of any GamesTally system or network
• Breach or otherwise circumvent any security or authentication measures
• Use automated means (bots, scrapers, crawlers) to access the platform except via documented APIs and within published rate limits
• Reverse engineer, decompile, disassemble, or attempt to extract source code from the platform
• Interfere with or disrupt the platform's servers, networks, or infrastructure
• Conduct denial-of-service attacks or otherwise overload the platform

3.3 Commercial Misuse

• Resell, sublicense, or redistribute access to GamesTally without our prior written consent (except via the White Label Plan, which is separately licensed)
• Use GamesTally to build a directly competing product
• Use GamesTally to send unsolicited bulk messages, spam, or unauthorised advertising
• Misrepresent your relationship with GamesTally

3.4 Privacy and Data Misuse

• Collect, harvest, or store personal information of other users without consent
• Submit personal data of third parties to the platform without ensuring you have a lawful basis to do so under applicable data protection law (e.g. PDPA, GDPR)
• Use the platform to violate any individual's privacy rights
• Share or expose login credentials with parties outside your organisation

3.5 Live Event Misconduct

• Use GamesTally to facilitate event activities that are unsafe, harmful, or illegal
• Use the platform to display content during live events that would violate Section 2 (Prohibited Content) above
• Manipulate scoring outcomes in bad faith to defraud event participants or organisers

4. Educator Tier Specific Rules

The Educator tier is offered at a reduced price to support legitimate educational use. To maintain Educator pricing, you must:

• Hold a verified institutional email address from an accredited educational institution
• Use the platform primarily for educational purposes (classroom activities, school events, university programmes, training courses)
• Not use the Educator tier for commercial corporate events
• Re-verify your institutional status when requested

Misuse of the Educator tier (e.g. commercial use, expired institutional affiliation, false claims) will result in transition to standard pricing or Account termination.

5. White Label Tier Specific Rules

White Label customers receive additional rights to customise the platform with their own branding. With these rights come additional obligations:

• White Label customers may not transfer, sublicense, or share their White Label privileges with third parties
• White Label customers remain responsible for the conduct of admin users they grant access to
• Custom branding must not impersonate GamesTally or other third parties
• Custom branding must not contain prohibited content (Section 2)
• White Label customers must accurately represent their relationship with GamesTally to their end users (e.g. "powered by" attribution where required by separate agreement)

6. Reporting Violations

If you believe another user is violating this AUP, please report it to abuse@gamestally.com with:

• The Account or content you are reporting
• A description of the suspected violation
• Any supporting evidence (screenshots, URLs, timestamps)

We will investigate reports promptly and take appropriate action, which may include warnings, suspension, or termination.

7. Consequences of Violations

Depending on the nature and severity of the violation, we may:

• Issue a warning
• Remove or modify offending content
• Limit or suspend Account access temporarily
• Terminate the Account permanently
• Refuse refunds for terminated Accounts (per Terms of Service)
• Report illegal activity to law enforcement
• Seek legal remedies, including damages and injunctive relief

We reserve the right to take any action we deem necessary at our sole discretion. We may act with or without notice depending on the severity and urgency of the violation.

8. No Obligation to Monitor

GamesTally has no obligation to monitor user content or activity, but reserves the right to do so for security, legal compliance, and operational reasons. Our decision not to act in a particular case does not waive our right to act in any other case.

9. Changes to This AUP

We may update this AUP from time to time. Material changes will be communicated via email or in-app notice and take effect 30 days after notification.
